1. Introduction and Acceptance

Welcome to Arkscape. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

You must be at least 18 years old to use Arkscape. By using our service, you represent that you are at least 18 years of age or have the consent of a parent or legal guardian.

2. Description of Service

Arkscape is a B2B collaboration platform designed for architecture and engineering teams. Our service provides project management, task coordination, and team collaboration tools to help organizations manage their projects and teams effectively.

3. Account Terms

To use Arkscape, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

Each user may only have one account. Sharing accounts between multiple individuals is not permitted.

4. Organization Accounts

If you create or manage an organization on Arkscape, you are responsible for:

  • Managing organization members and their access levels
  • Ensuring all organization members comply with these Terms
  • Maintaining appropriate billing information for the organization
  • The content and data created within your organization

5. Subscription and Payment Terms

Arkscape offers subscription-based pricing with Organization Plans and Member Plans.

Free Trial

New subscriptions include a 14-day free trial. During this period, you have full access to evaluate our service at no cost. No payment is required until the trial ends.

Billing

After your trial ends, subscriptions are billed monthly in advance. All fees are quoted in US dollars (USD) unless otherwise specified. You authorize us to charge your payment method on a recurring basis.

Price Changes

We may change our prices from time to time. We will provide at least 30 days' notice before any price changes take effect. Your continued use after the price change constitutes acceptance of the new pricing.

6. Cancellation and Refunds

Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation:

  • Your access continues until the end of your current billing period
  • No further charges will be made after cancellation
  • You may export your data before your access ends

Refund Policy

As we offer a 14-day free trial, subscriptions are generally non-refundable after payment is processed. Downgrades take effect at the next billing cycle, and no partial refunds are provided for the current period.

7. Acceptable Use Policy

You agree not to use Arkscape to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others

  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Harass, abuse, or threaten other users
  • Use the service for any illegal or unauthorized purpose
  • Interfere with or disrupt the integrity or performance of the service
  • Share content that is unlawful, harmful, or objectionable

We reserve the right to suspend or terminate accounts that violate these guidelines.

8. Intellectual Property

Arkscape and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of all content you create on Arkscape. By using our service, you grant us a limited license to store, display, and process your content solely to provide the service to you.

9. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Third-Party Services

Arkscape integrates with third-party services to provide our platform:

  • Stripe for payment processing
  • DigitalOcean for cloud hosting
  • Cloudflare for content delivery and security

Your use of these third-party services is subject to their respective terms and privacy policies.

11. Disclaimers

ARKSCAPE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the service will be uninterrupted, secure, or error-free. We strive for high availability but cannot guarantee specific uptime percentages.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKSCAPE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Arkscape and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the service or violation of these Terms.

14. Termination

We may suspend or terminate your access to Arkscape at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us or using the account deletion feature.

Upon termination, your right to use the service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Arkscape shall be resolved in the appropriate courts.

16. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or through the service. Your continued use of Arkscape after changes become effective constitutes acceptance of the revised Terms.
